A Forum on Enforcement
TRA began running this annual event in 1990. Over the past 20 years it has become extremely popular and has established itself as the largest gathering in the UK of those at the sharp end of the statutory planning system.
The most recent Forum took place in Manchester on 20 October 2011 and topics covered included:
- An update on recent case law relating to enforcement, a particularly litigious area of planning
- One of the most high profile cases of the year - Welwyn Hatfield against Mr Beesley and CLG (the barn that was always going to be a dwelling) as it came before the Supreme Court, focusing on the Council's interpretation of s171B of the Act on "immunity" and when the "Connor Principle" can be applied
- A workshop on various topics under the banner of "Investigative Skills"
- The concept of abandonment, identifying criteria to be used in analysing whether or not abandonment of a use has occurred, and the implications for planning enforcement working practices
- "Gamekeeper turned poacher" - a look at accumulated examples of good (and bad) practice amongst enforcement officers and planning consultants, and how parties can work together to achieve the right solution
- An update on where things stand and the likely timescales for the many changes affecting the planning world in the coming year.
